Terms of Service

These Terms of Service ("Terms") govern your access to and use of Paddle Explorer ("the app" or "the Service"), a private, invite-only, non-commercial web application operated by an individual ("the Operator") at bisonfoundry.com/paddle. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

• The Service is offered to a small number of invited adults. You must be at least 18 (or the age of majority where you live) to use it.
• Registration requires an invite code. You are responsible for keeping your username and password confidential and for all activity under your account, and you agree to notify the Operator promptly of any unauthorized use.
• Accounts are personal. Do not share your account or invite codes without the Operator's permission.

2. The Service is informational only

• Paddle Explorer suggests possible times and places to paddle using tide, weather, UV, water-quality, and map data obtained from third parties. It is provided for general informational and planning purposes only.
• The information may be inaccurate, incomplete, out of date, or unavailable. The Service is not a navigation, weather, or safety device and is not a substitute for official sources, professional advice, or your own judgment.

3. Assumption of risk and personal safety

Paddling, kayaking, canoeing, and related water activities are inherently dangerous and can result in serious injury or death. You engage in these activities entirely at your own risk.

• You are solely responsible for your own safety and that of anyone with you, including assessing actual on-the-water conditions, your skills and physical fitness, your equipment (including personal flotation devices), and all applicable laws and local rules.
• Always verify conditions with official sources — such as the National Weather Service / NOAA, the U.S. Coast Guard, and local authorities — before going out. Do not rely on the Service for any safety-critical decision.
• The Operator does not guarantee that any location, time, route, or condition suggested by the Service is safe, accessible, lawful, or suitable for you.

4. Acceptable use

You agree not to: use the Service unlawfully; attempt to gain unauthorized access to the Service, other accounts, or the server; disrupt, overload, attack, or probe the Service or the third-party services it uses; scrape or harvest data; reverse engineer or copy the Service except as permitted by law; or use the Service to harass others or infringe their rights. The Operator may suspend or terminate access at any time, including for suspected violation of these Terms.

5. Google account features

If you connect a Google account, you authorize the Service to create, find, and remove the calendar events you choose, and to search your contacts to suggest invitees, as described in the Privacy Policy. You are responsible for the events you schedule and the people you invite, and for complying with Google's terms. You may disconnect or revoke access at any time.

6. Third-party data and services

The Service relies on third-party providers (including OpenStreetMap, NOAA, Open-Meteo, the U.S. EPA, Mapillary, and Google). The Operator does not control and is not responsible for the accuracy, availability, or content of those services, and your use of them may be governed by their own terms and policies.

7. No warranty

THE SERVICE AND ALL INFORMATION IT PROVIDES ARE OFFERED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY INFORMATION WILL BE ACCURATE OR CURRENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY INFORMATION IT PROVIDES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, THE OPERATOR'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE U.S. DOLLAR (US$1.00). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; nothing in these Terms limits any liability that cannot be limited under applicable law.

9. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless the Operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, the events you schedule or invitations you send, your violation of these Terms, or your violation of any law or third-party right.

10. Termination

You may stop using the Service at any time and may delete your account from the Account menu in the app. The Operator may modify, suspend, or discontinue the Service, or terminate or suspend your access, at any time and without notice. Provisions that by their nature should survive termination (including Sections 6 through 9, and 12) will survive.

11. Changes to these Terms

The Operator may update these Terms; the "last updated" date will change accordingly, and material changes will be posted on this page. Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the District of Columbia, USA, without regard to its conflict-of-laws rules. To the extent permitted by law, you agree to the exclusive jurisdiction of the state and federal courts located in the District of Columbia for any dispute relating to these Terms or the Service.

13. Privacy

Your use of the Service is also subject to the Privacy Policy, which is incorporated into these Terms by reference.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. The Operator's failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and the Operator regarding the Service.
